Before I file a patent application, I will always do a patent search to make sure that no one has tried to patent this invention before. That can prevent the application from being processed. If you fail to go through a patent search to ensure no one else has your product, it can ultimately result in a denial from the Patent and Trademark Office, and wasted money, and wasted time.

Prior to completing and filing an application for your patent, I will check the files of the Patent and Trademark Office, research the Internet, and other sources to make sure that that idea hasn’t been patented before. This is important, not only because the patent office will not grant the patent if it’s not considered novel, but also because if the invention is being used by someone else beforehand, they have the monopoly rights to that patent, and they would be able to require you to cease and desist and can possibly sue for quite a bit of money if you infringe on their existing patent.

Once the patent search is complete and you are able to file your patent application, it is important to be aware of the fees you will have to pay to continue with the process. There is also a fee that you will be required to pay to conduct the patent search, the design search fee, the utility fee, and others through the Patent and Trademark Office.
