Considering alternative dispute resolution

The Law Offices of Richard E. Novak, LLC will not dive into an expensive legal battle every time our clients need to take action because of an intellectual property matter. Working with each client, we will explore all legal means to resolve the issue outside of court, avoiding the financial impact of litigation. Arbitration

Some licensing agreements include the condition that cases of a breach of contract must be resolved through arbitration instead of litigation. The process is binding and confidential. Arbitration involves a panel of attorneys who have vast knowledge on the legal matter at hand. These arbitrators act as judges, hearing each side of the case and deciding on the matter for the group. Once the process concludes, the arbitrators will issue a decision that is binding and cannot be appealed.

Mediation

Another alternative to litigation is the process of mediation. This method is a popular choice for clients hoping to avoid a court case. This process is far less structured than arbitration. It is also much cheaper than arbitration and litigation. Through a neutral third-party, parties will constructively discuss the matter and come to a solution that is acceptable to both parties. The mediator does not take any evidence into consideration. The goal is to have the parties engage in a discussion about their differences and draft a binding legal document that resolves the matter. If either party is not happy with the process, they can end it at any time.
