What are the Consequences of Driving With a Suspended License in New Jersey?

When a person is given their driver’s license, they are trusted to follow the rules of the road. It is important to understand this is a privilege and not a right. It is because of this that a driver’s license can be taken away if the individual violates the rules of the road. When a license is suspended or revoked, a person is no longer permitted to drive a vehicle. If they choose to do so anyway, they are in further violation of the law and can receive another traffic violation. What are the Penalties of Driving With a Suspended License?

It is very dangerous for someone to drive when their license is suspended. The state of New Jersey is strict in enforcing the laws of the road, including the need to have a valid license. Individuals who violate the law can face significant consequences as a result of their actions. According to N.J.S.A. 39:3-40, the following are the penalties for driving with a suspended license in New Jersey:

  • $500 fine, additional license suspension not to exceed 6 months for a first offense
  • $750 fine, additional license suspension not to exceed 6 months, imprisonment up to 5 days for a second offense
  • $1000 fine, additional license suspension not to exceed 6 months, imprisonment for 10 days for a third or subsequent offense

Combination Offenses

When a driver has a history of violating the rules of the road and engaging in unsafe behavior, they can be a liability on the road. This is because it is possible for them to severely injure another person while operating a vehicle. In the event of this, additional consequences may be imposed. If a person without a license injures another person while driving with a suspended license, they can face jail time from 45 to 180 days. If they cause the death of another person while driving with a suspended license, they can be charged with a crime in the third degree.
